What Is Cease and Desist?
A cease and desist letter is a formal legal notice sent by a trademark owner (or their attorney) to a domain registrant, demanding they stop using a domain name that allegedly infringes on the sender's trademark rights.
Receiving a cease and desist is not a court order — it's a warning that legal action may follow if the recipient doesn't comply. However, it should be taken seriously. The letter typically demands that you transfer or cancel the domain, stop using the contested name, and may threaten UDRP proceedings or an ACPA lawsuit.
Not all cease and desist letters are legitimate threats. Generic dictionary words, common phrases, and terms with multiple trademark holders across different classes may be defensible. If you receive one, consulting a domain attorney before responding is strongly recommended.
Why This Matters for Startups
You might encounter cease and desist letters from two angles. As a startup, you might send one if someone registers a domain confusingly similar to your trademarked brand. Or you might receive one if your chosen domain conflicts with an existing trademark you weren't aware of. Before launching with any domain, search the USPTO and EUIPO trademark databases to avoid surprises. If you receive a C&D, don't panic — but don't ignore it either. Get legal advice promptly.
